Introduced by DMA Yachting, the majestic charter yacht ESCAPE is a 88 ft sailboat featuring a hot tub. The highlights of ESCAPE are her absolute comfort and experienced crew. ESCAPE spends the summer and winter season in Turkey. She was completed by the renowned boatbuilder Fethiye Shipyard in 1994. A comprehensive refit was fulfilled in 2022. The expansive yacht layout features 6 generous cabins and comfortably accommodates a maximum of 12 guests.

MYBA CONTRACT SPECIAL CONDITIONS:
1. Charter fee and operating costs may be subject to VAT, depending on cruising grounds. Charterer acknowledges responsibility for any taxes levied against this agreement.
2. The Broker confirms that due diligence checks on the Client have been conducted, as mandated by applicable laws, and that said checks have been found compliant with AML regulations. At Stakeholder’s first request, the Broker undertakes to share with the Stakeholder the due diligence documents gathered from the Client.
3. Children are to be under supervision of an adult in the charter party at all times.
4. It is highly recommended that the Charterer consider obtaining Personal Travel Insurance, Cancellation/ Curtailment Insurance, and Charterer’s Liability Insurance.
5. Crew gratuity is customary (standard between 5-10 % of charter fee), it is given at the Charterer’s discretion.
6. Use of personal watercraft is only permitted subject to the operator having the appropriate license and meeting with local regulations. Any liability arising from non-compliance is entirely at the operator’s risk.
7. No pets are allowed inside the yacht.
8. No smoking is allowed inside the yacht.
9. Payment is to be made by wire transfer; all bank fees are at the Charterer’s expense.
10. All APA accounts should be settled on board prior to disembarkation.
11. Water sports can be available on board but will require 1 crew member so there will be a limitation in the service to the guests when using the water toys.
12. *Included in the published charter fees: Yacht's insurance, fuel for up to 3 hrs cruising per day for main engines and generators, Gocek municipality harbour fees.
13. *Excluded in the charter fee (and settled from the APA): Meals, drinks, fuel for water sports, private marina fees, land arrangements and tours.
14. ESCAPE is only allowed to cruise in Turkish waters.
15. The owner agrees to make all efforts to find replacement of the crew in case of absence but cannot be guaranteed at all times.
16. In contrary to Clause 9 c) ‘FAILURE TO DELIVER’ of this agreement, the owner agrees as following: c) If the OWNER fails to deliver the Vessel at the Place of Delivery at the commencement of the Charter Period other than by reason of force majeure; the CHARTERER shall be entitled to treat this Agreement as repudiated by the OWNER. The CHARTERER will be entitled to immediate repayment without interest of the full amount of all payments made by him under the terms of this Agreement and shall in addition be paid by the OWNER liquidated damages of a maximum amount equivalent up to twenty-five percent (25%) of the Charter Fee, provided that no similar replacement vessel can be found by the OWNER within forty-eight (48) hours as from the scheduled charter commencement date and all suffered damages and incurred expenses are duly documented by the CHARTERER.
17. In contrary to Clause 9 e) CANCELLATION BY OWNER of this agreement, the owner agrees as following: e) If the cancellation is for any reason, other than force majeure, the CHARTERER shall be entitled to immediate repayment without interest of the full amount of all payments made by him under the terms of this Agreement and shall in addition be entitled to liquidated damages from the OWNER for a maximum amount of twenty-five percent (25%) of the Charter Fee, provided that no replacement vessel can be found by the OWNER within forty-eight (48) hours as from the scheduled charter commencement date and all suffered damages and incurred expenses are duly documented by the CHARTERER.
18. “Limb (c) of Clause 11 (Cancellation by Charterer & Consequences of Non-Payment, Default of Payment or Failure to Pay) will now read as per below: If, after signature of this Agreement, the OWNER or the Charterer is adjudged bankrupt or, in the case of a company, a liquidator, receiver or administrator is appointed over all or part of assets of the relevant party, the other party shall be entitled to cancel the Charter and the Agreement shall be deemed terminated. In cases of the bankruptcy of the Owner, all monies paid to the OWNER, the Broker or the Stakeholder pursuant to this Agreement shall be refunded without further deduction. In cases of bankruptcy of the Charterer, all monies paid to the OWNER by the Charterer to date shall be retained by the Owner.”
19. In addition to Clause 13 and as per the subject procedural rules of LMMA it is confirmed that the third arbitrator will be appointed by the two arbitrators (appointed by each party under the agreement) and if not, by the president.
